REGULAR MEETING – NOVEMBER 12, 2008



            The regular meeting of the Town Board of St. Armand was held on the above

date at the Town Hall, Bloomingdale, NY.


PRESENT:     Supervisor Joyce W. Morency, Councilmen Earl J. Dakin, Jr., Samuel                               Grimone, Thomas Jones; Town Clerk Cynthia A. Woodson, and Highway                                 Superintendent Roger Oliver


EXCUSED:    Councilman Charles Whitson, Jr.


GUESTS:       DeForest & Arlene Tinkler 


            Supervisor Morency called the meeting to order at 7:00 P.M.


            The Pledge of Allegiance was led by Supervisor Morency.


RESOLUTION #69 – MINUTES


            A motion was made by Councilman Grimone, and seconded by Councilman Dakin to accept the Regular Town Board meeting minutes of October 14th, the Public Hearing on the Preliminary Budget and the Special Board Meeting minutes on November 5th. All were in favor. Motion carried.


RESOLUTION #70 – MONTHLY BILLS


            GENERAL: Vouchers #234 – 256, Abstract #11                   $17,571.19

            HIGHWAY: Vouchers #187 – 203, Abstract #11                  $13,339.33

            WATER & SEWER: Vouchers #129 – 142, Abstract #11     $18,522.70

 

            A motion was made by Councilman Jones, and seconded by Councilman Grimone to accept and pay this month’s bills. All were in favor. Motion carried.


RESOLUTION #71 – SUPERVISOR’S REPORT


            RECEIPTS:                                                    $ 43,954.66

            DISBURSEMENTS:                                      $157,047.60

            CHECKING BALANCES:                            $ 82,154.68

            SAVINGS BALANCES:                               $415,184.19

            CASH BALANCES:                                      $497,338.87

            WATER & SEWER BALANCE:                  $ 11,396.89


            A motion was made by Councilman Grimone, and seconded by Councilman Dakin to accept the Supervisor’s Report, Water & Sewer Report, and Financial Reports. All were in favor. Motion carried.


WATER & SEWER DISTRICTS


            Councilman Jones asked about the Water & Sewer Superintendent, Bart Crary, if he charges for mileage. Supervisor Morency stated no, but the Clerk and Connie do for their banking. Councilman Dakin stated that Bart used to use the Water & Sewer truck for traveling back and forth to his home and to work. Supervisor Morency stated that has been stopped for about two years. Water & Sewer Clerk stated that the water rates were increased again from $2.50 to $3.00 per thousand gallons used. Supervisor Morency stated this was in the 2009 budget.


JUDGE’S AUDIT


            Supervisor Morency stated that she needs a Resolution approving the Judge’s Audit done by Connie Willette.


RESOLUTION # 72 – APPROVE JUDGE’S AUDIT

Councilman Grimone, who moved its adoption, offered the following resolution.


WHEREAS A Resolution of the Town Board of the Town of St. Armand accept and approve Justice Sheridan Swinyer’s Audit done by Connie Willette, Clerk to the Supervisor, as presented on the Annual Audit Checklist.


This Resolution was duly seconded by Councilman Dakin, and adopted as follows:

CELL TOWER


            Supervisor Morency stated that she has the lease back but the Town Attorney, Dan Manning, will review it and make some corrections and amendments. There are two changes that have to occur. Councilman Jones asked that once the project starts, with putting the base in and construction, does then Verizon starts paying the Town? Supervisor Morency stated that payment begins at start of construction. Councilman Grimone stated if twelve months goes by and nothing is done, either party can terminate the lease.


RESOLUTION #73 – VERIZON CELL TOWER


Councilman Grimone, who moved its adoption, offered the following resolution.


WHEREAS A Resolution of the Town Board of the Town of St. Armand give Supervisor Morency permission to sign the amendment to two changes in original lease.

 

            1. Change six months to twelve months of lease

            2. Amend the Right of Way for road to tower to 30 feet instead of 15 feet

TOWN HALL STEPS


            Supervisor Morency stated that it is too late to do any repairs to the steps for this winter.


SUNMOUNT


            Supervisor Morency stated she received a phone call from Mrs. DeSanto and that they have looked at other places; have not been back over to Rockledge.

HIGHWAY


            Roger stated that the new truck is nearly completed with plow and dump box. It should be delivered by the end of December. Supervisor Morency stated that the Town Attorney, Dan Manning, will do bonding for the truck, interest from Mack. He is checking on the interests from other banks and will let her know. Roger stated that they have been using the water truck to flush the leaves out of the culverts and manholes.


STATE SALT/SAND CHANGES


            Roger stated that the State has determined when and how to use the salt and sand when plowing. Minus 20 degrees, use the sand and salt mix, and minus 10 degrees use the salt.


WOOD BOILERS & GENERATORS


            Councilman Grimone stated that he has been working on a comparison of regulations for outside wood boilers from several different towns. He plans on having it completed before spring so the Town Board can decide what to do.


            Councilman Grimone asked if the generators have been serviced. Supervisor Morency stated that nothing has been done yet on the generators. She will call Mr. Besaw and find out what is happening. 


BARNARD BUILDING


            Councilman Jones stated that he would like to see some money go to the Barnard Building for painting. Supervisor Morency stated that it is in such bad shape, don’t know whether to fix it up or tear it down. Right now it is being used for storage with the highway equipment. Councilman Jones asked whether the building should be condemned. Supervisor Morency stated that the Code Enforcer would have to look at it. Councilman Dakin stated that St. Armand has no zoning so the code enforcer has no grounds to condemn a building. Roger stated that the right side of the building is leaning toward the post office. He stated that maybe Joe Garso can come and look at it to see if the building is worth saving. Councilman Jones stated that the cost would be too high to bring the building up to code.
