SPECIAL BOARD MEETING

Chairman Gillilland called this Special Board Meeting to order at 11:10 am with the following Supervisors in attendance: Clayton Barber, Matthew Brassard, Chris Clark, Robin DeLoria, Derek Doty, Shaun Gillilland, Charlie Harrington, Kenneth Hughes, Steve McNally, Jim Monty, Cathleen Reusser, Favor Smith, Matthew Stanley, Michael Tyler, Davina Thurston, Meg Wood and Mark Wright.  Joe Pete Wilson was excused.

 

Department Heads present: Angie Allen, Judy Garrison, Krissy Leerkes, Mike Mascarenas and Dan Manning.  

 

News Media present: None.

 

GILLILLAND:  I call this special meeting of the Board of Supervisors to order and we’ll start with the roll call please.  Thank you.  Can I have the call of the meeting please Jude.

 

GARRISON:  Dear Ladies and Gentlemen:

Upon the direction of Shaun Gillilland, Chairman, you are hereby notified, that pursuant to and in accordance with Section 151 of the County Law, a Special Board Meeting of the Essex County Board of Supervisors will be held at Elizabethtown, New York at the Essex County Board of Supervisors Chambers on Monday, May 13, 2024 at 11:00 a.m., for the purposes of:

1.         Resolution adopting a Home Rule Request for enaction and adoption by the New York State Senate of Senate Bill S.8583-A and by the New York State Assembly of Assembly Bill A.9277-A entitled, “an act to amend the tax law, in relation to expenditures for Essex County Correctional and Public Safety Facility Projects; and to amend Chapter 327 of the Laws of 2006 amending the tax law relating to authorizing the County of Essex to impose an additional mortgage recording tax, in relation to extend the effectiveness thereof.”

2.         Changing the Regular Essex County monthly Board Meeting from Monday, June 3, 2024 to Tuesday, June 4, 2024 at 10:00 a.m.

GILLILLAND: Thank you. We have no guests, so we’ll go to resolutions please.

 

RESOLUTION #130 – ADOPTING A HOME RULE REQUEST FOR ENACTION AND ADOPTION BY THE NEW YORK STATE SENATE OF SENATE BILL S.8583-A AND BY THE NEW YORK STATE ASSEMBLY OF ASSEMBLY BILL A.9277-A ENTITLED, “AN ACT TO AMEND THE TAX LAW, IN RELATION TO EXPENDITURES FOR ESSEX COUNTY CORRECTIONAL AND PUBLIC SAFETY FACILITY PROJECTS; AND TO AMEND CHAPTER 327 OF THE LAWS OF 2006 AMENDING THE TAX LAW RELATING TO AUTHORIZING THE COUNTY OF ESSEX TO IMPOSE AN ADDITIONAL MORTGAGE RECORDING TAX, IN RELATION TO EXTEND THE EFFECTIVENESS THEREOF.”

This resolution was moved by Mr. Hughes seconded by Mr. Monty and adopted upon a two-thirds roll-call vote as follows:

NOES:                  0 votes

ABSENT:          123 votes     (Wilson)

GILLILLAND:  Discussion?

 

MANNING:  Just a little explanation as you know Essex County collects two mortgage taxes which involves one, we receive a quarter percent twenty-five cents ($.25) on every hundred dollars of a mortgage. We’ve been through this before. We used to do it every three years. We started out being this year or the tail end of last year asking for home rule for this, we submitted the home rule request for a three year period the legislation incidentally has determined that it needed to be a two year period so we came back to you and we did another resolution for a two year period. So now I get a call last week I think late Thursday or Friday saying, oh, there’s some fighting or whatever now they want to go back to three years which is what we originally did. So, this is simply a home rule request to have the ability to collect this mortgage tax for the next three years from December 1, 2024 through November 30, 2027.  One other thing it does is also in the past the monies that we received from this particular mortgage tax which only be used for the Essex County Correctional Facility and Public Safety projects we’ve now been able to change that language so that once these projects paid off I think they are soon?

 

MASCARENAS: We have one that will be paid at the end of this year and one that will be paid next year.

 

MANNING: After that these monies will no longer be earmarked for specific purposes but go in the general fund which makes it much easier for you to advocate these monies.  So that’s where we are at.

 

GILLILLAND: Thank you. Any further discussion?  This requires a two-thirds vote to ratify so roll call please.

 

RESOLUTION #131 – CHANGING THE DATE OF THE JUNE REGULAR BOARD MEETING FROM JUNE 3, 2024 TO JUNE 4, 2024.

This resolution was moved by Mr. Hughes, seconded by Mr. Brassard and duly adopted.

 

GILLILLAND: Discussion? Being none, all in favor, opposed – carries.  No further business on the agenda for this special board meeting. We are adjourned.

 

            As there was no further discussion to come before this special board meeting it was adjourned at 11:15 a.m.
